1. Agreement to Terms

By accessing, browsing, or purchasing from KudosCard (“we”, “us”, “our”), you agree to be bound by these Terms of Service in full. If you do not agree to any part of these Terms, you must not use this site or place an order. These Terms apply to all visitors, users, and customers.

2. Products & Descriptions

KudosCard sells physical NFC cards intended for personal and professional use (e.g. collecting Google reviews, sharing contact information, linking to websites). Product descriptions, images, and specifications are provided in good faith and are as accurate as reasonably possible. We reserve the right to correct errors, update listings, and discontinue products at any time without notice.

Product images may be representational. Exact appearance, color, and finish may vary slightly from images shown. This does not constitute grounds for a refund or dispute.

3. Pricing & Payment

All prices are listed in USD and are subject to change without notice. Payment is due in full at checkout. We accept all major credit and debit cards via our payment processor (Stripe). Orders are not confirmed until payment is successfully processed and verified.

4. No Refunds — All Sales Final

All sales are final. We do not offer refunds, returns, or exchanges under any circumstances except where required by applicable law. By completing a purchase, you expressly waive any right to a refund for reasons including change of mind, incompatibility, or ordering error. Please refer to our Refund Policy for full details.

5. Permitted Use

You may use KudosCard NFC cards only for lawful purposes. You expressly agree not to use our products to:

• Distribute malware, viruses, or malicious code
• Conduct fraud, phishing, or identity theft
• Collect personal data without the knowledge or consent of the data subject
• Violate any local, state, national, or international law or regulation
• Infringe upon the intellectual property rights of any third party

We reserve the right to refuse service to anyone for any reason at any time.

6. Intellectual Property — Our Content

All content on this website — including but not limited to text, images, graphics, logos, product photography, copy, and the overall store design — is the exclusive property of KudosCard and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, publicly display, or use any of our content without our express prior written permission.

7. Third-Party Trademarks & Disclaimer

KudosCard is an independent business and is not affiliated with, endorsed by, sponsored by, or in any way officially connected to Google LLC, Alphabet Inc., or any of their subsidiaries or affiliates.

All third-party trademarks, service marks, logos, and brand names (including “Google” and the Google logo) referenced on this site or on our products are the exclusive property of their respective owners. Any reference to such marks is solely for descriptive and nominative fair use purposes — to accurately describe the functionality of our NFC cards (i.e., that they link to Google review pages). Such references do not imply any endorsement, sponsorship, or affiliation.

Our NFC cards are generic physical products that can be programmed to link to any URL, including Google review pages. We make no claim of ownership over any third-party brand or platform.

8. Disclaimer of Warranties

Our products and this website are provided “as is” and “as available” without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that NFC cards will be compatible with all devices, operating systems, or third-party platforms, or that the website will be error-free or uninterrupted.

NFC functionality depends on the customer's device hardware and software. We are not responsible for compatibility issues with specific devices, cases, or settings.

9. Limitation of Liability

To the fullest extent permitted by applicable law, KudosCard, its owners, employees, and agents shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages of any kind arising out of or related to your purchase or use of our products or this website — including but not limited to loss of revenue, loss of data, loss of goodwill, or business interruption — even if we have been advised of the possibility of such damages.

In all cases, our maximum aggregate liability to you for any claim arising out of or related to these Terms or your order shall not exceed the total amount you paid for the specific order giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless KudosCard and its owners, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of our products or website; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or your purchase shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in the applicable jurisdiction, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights.
